Mark Olic Porter is facing a third-degree felony aggravated assault charge for allegedly attacking the neighbor, who came to defend his son after the altercation.

A witness told police that Porter was "loudly making racist comments to another neighbor's child," court documents indicate.

"The child's father โ€ฆ approached and told Porter not to speak like that to his son," the charges state. "Porter then hit [the man] with something and it sounded like [he] was being shocked. [The man] was thrown backward onto the sidewalk."

The boy's father later told police that he heard Porter yelling, "Get out of here, [nโ€”ger]," at his son, "who was riding his scooter in a common area" of an apartment complex.

"[The man said he] told Porter not to yell at his son. Porter then reached over the railing and hit [the man] with a stun cane," the charges read.

The neighbor confirmed that he received a shock from the object, but was able to get it away from Porter, according to the report.

Police officers were called to the scene and said that Porter then claimed that the neighbor he attacked had stolen his cane. A Draper officer said that Porter "smelled of alcohol."

The older man then struggled with two Draper police officers, knocking off a female officer's body camera and elbowing her, KSL.com reports.

"Porter continued to yell at officers and threatened to defecate while in the back of the patrol car, which he did," the charges read.

Porter is also facing charges ofย assault against a police officer, interference with an arresting officer and intoxication.

According to KSL.com, jail records indicate Porter bailed out of Salt Lake County Jail.
