The Cook County state's attorney's office had charged 18-year-old Eugene Bailey, but authorities announced Monday that they've dropped the charge and he's being released from custody.

Prosecutors originally said Bailey dealt the "knockout punch" that killed Derrion Albert.Β  It's not immediately clear why the charges were dropped.

Three other teens, Silvanus Shannon ,19, Eugene Riley ,18, and Eric Carson, 16, are facing charges in the melee captured on a cell phone video. That video shows a group striking 16-year-old Derrion Albert with boards and kicking him as he lay on a sidewalk. Albert was a sophomore at Christian Fenger Academy High School in Chicago.

Bailey's mother is adamant her son is innocent and his brother, Levar Johnson, told reporters that his brother was home at the time of the fatal attack.
